This class action lawsuit has been filed by Klein Lawyers in the Supreme Court of British Columbia on December 16, 2013 against Smith & Nephew Inc. of Canada that manufactured and distributed the Birmingham Hip Resurfacing System, implants used in hip replacement and resurfacing surgery. The firm is proceeding with the investigation on behalf of those individuals who suffered metallosis, premature device failure and other complications associated with the Smith & Nephew’s Birmingham Hip Resurfacing System.
The lawsuit alleges that the implants have an unreasonably high failure rate and that the defendants should have known of the inherent risks of metal-on-metal hip replacement designs before they ever marketed them. The decision to market the metal-on-metal hip resurfacing system was negligent as they have an unreasonable propensity for premature failure. It also alleges that people implanted with the products in Canada suffered personal injuries when their hip implants failed.
