On September 27, 2021, Justice McEwan of the Ontario Superior Court will hear motions by three of the defendants for a further six month extension of the orders that stay all court proceedings against Imperial Tobacco, Rothmans and JTI-Macdonald.

March 31, 2021

On March 31, 2021, Justice McEwen of the Ontario Superior Court granted Imperial Tobacco’s request for a further 6 month extensionof the orders that stays all court proceedings against Imperial. Similar extension orders were granted to Rothmans and JTI-Macdonald.

The extension was granted to permit the parties to continuethe negotiations to develop a consensual plan for resolutionof the billions of dollars in claims being asserted against the tobacco companies. Those negotiations are being conducted with the assistance of a court appointed mediator, the Honourable Warren K. Winkler, a former Chief Justice of Ontario. As counsel for the Knight class action, lawyers from Klein Lawyers LLP are participants in those negotiations.

The parties argued the question of class “certification” before Madam Justice Satanove of the British Columbia Supreme Court on October 25 to October 30, 2004. At the conclusion of the hearing, Madam Justice Satanove reserved her decision to carefully consider all of the evidence and legal arguments. Her Honour’s decision, when released, will determine whether or not this case can forward as a class action.2015
