A class action lawsuit has been certified against Weston by its independent bread distributors. The class action lawsuit alleges that Weston participated in an illegal conspiracy to fix the price of fresh bread and concealed this wrongdoing from the class members (the distributors of Weston fresh bread). As a result of the Defendants’ wrongdoing, it is alleged that the Class members suffered substantial losses of revenue, lost sales, and capital losses of the value of their businesses.
The conspiracy was made public on December 19, 2017 when Weston issued a press release publicly admitting to participating in an industry-wide conspiracy to fix the price of bread. Weston stated that beginning in 2001, they had a “role in an industry-wide price-fixing arrangement involving certain packaged bread products.” Weston admitted further that the “arrangement involved the coordination of retail and wholesale prices of certain packaged bread products,” and “the participants regularly increased prices on a coordinated basis.”
The Honourable Justice Rady of the Superior Court of Justice in Ontario certified the case as a class action to include, all persons resident in Canada who carried on business under a distribution agreement with the defendant, Weston Bakeries Limited, during the period between January 1, 2001 and October 1, 2024. Weston tried to appeal this decision, however, their appeal was dismissed by the Court of Justice – Ontario Divisional Court in 2025.
